These Terms govern your use of MindMatch. By creating an account or using the site, you agree to them. If you don't agree, don't use MindMatch.

1. What MindMatch is — and isn't

MindMatch is an online platform that helps people discover and contact independent mental health providers and treatment programs. MindMatch does not provide medical, psychological or psychiatric care, does not employ the providers listed, and is not a party to any treatment relationship. MindMatch is not an emergency service. If you are in crisis, call or text 988 or call 911.

2. Eligibility

You must be at least 18 years old and able to form a binding contract. You agree the information you provide, including your date of birth and state of residence, is accurate.

3. Accounts

Keep your password confidential and tell us right away if you suspect unauthorized access. You're responsible for activity under your account.

4. Providers and facilities

If you list yourself or a program, you represent that you hold every license, certification and authorization required to offer your services in each state you select, that your profile is accurate and current, and that you will comply with all laws and professional ethics codes that apply to you, including those on advertising, confidentiality, informed consent and telehealth. Verification by MindMatch is a limited check at a point in time and is not a guarantee or endorsement. You are solely responsible for the services you provide, your fees, insurance billing and your records.

5. Clients

You are responsible for choosing a provider. Before starting care, confirm the provider's credentials, availability, fees and insurance coverage directly with them. Match labels reflect how well a profile fits your stated preferences, not a clinical judgment.

6. Messaging

Messaging is for introductions and scheduling. Don't use it to deliver treatment, share detailed medical records, or send payment information. We may review messages when needed to investigate reports, enforce these Terms or comply with law.

7. Acceptable use

You agree to follow our Acceptable Use Policy. We may suspend or remove accounts and content that violate it.

8. Content you provide

You keep ownership of what you upload. You grant MindMatch a non-exclusive, worldwide, royalty-free license to host, display and distribute that content as needed to run and promote the service. You confirm you have the rights to anything you upload, including photos.

9. Fees

Using MindMatch as a client is free. Any fees for provider or facility features will be shown before you agree to them and are governed by our Return Policy. Fees for care are between you and your provider.

10. Disclaimers

MindMatch is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We don't warrant the accuracy of listings or that any provider will be available or suitable. See our Disclaimer.

11. Limitation of liability

To the fullest extent permitted by law, MindMatch and its owners will not be liable for indirect, incidental, special, consequential or punitive damages, or for any harm arising from services provided by any provider or facility. Our total liability for any claim relating to MindMatch is limited to the greater of $100 or the amount you paid us in the 12 months before the claim.

12. Indemnity

You agree to defend and indemnify MindMatch against claims arising from your content, your services (if you are a provider or facility), or your violation of these Terms or the law.

13. Termination

You can delete your account at any time. We may suspend or end access if you violate these Terms or to protect users. Sections that by their nature should survive termination will survive.

14. Governing law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Denver, Colorado, unless applicable law requires otherwise.

15. Changes

We may update these Terms. We'll post changes here and, for material changes, notify you. Continuing to use MindMatch after changes take effect means you accept them.
